To advertise a property for sale in NSW, either by a Real Estate or privately by law, you are required to have a Contract of Sale prepared.

It is important that when selling your property that your are aware of your legal obligations, especially in situations when you have privately listed your property for sale via an online platform.

LMS Conveyancing will prepare your sale contract on the same day we receive instructions, with the relevant terms and conditions, together with the mandatory prescribed documents and forward to the Real Estate or yourself so they/you can advertise your property.

Once you have accepted an offer for the sale of your property LMS Conveyancing will liaise with the purchasers representative regarding any legal questions and further negotiations or amendments to the contract to get you locked in (exchanged).

Once you are exchanged LMS Conveyancing will work together with relevant parties, including your bank if required and real estate to make sure all requirements are met and your settlement is completed on time.

After completion a full report of your settlement details and relevant correspondence will be forward to you.

Once you have made an offer to the agent and it has been accepted by the vendor, I can help you from reviewing and advising on  your contract right through to settlement when the keys are being handed over to your new property.

Having a pre approval from your bank if you are requiring a loan can help speed up the process to have you locked into your new home sooner.

As the contract comes from the vendors solicitor this is a good time to arrange all of your pre-purchase inspections. I can help you arrange inspections and certificates such as pest and building reports, Survey report, building structural reports, Strata reports and building information reports if required.

Once the contract is received I will very carefully review and explain to you in plain English what terms and conditions are enclosed, negotiate any further conditions and make sure if any loan approvals are unconditional.

The deposit is required to be paid with the real estate agent and will be retained as a stakeholder until settlement. Sale Contracts usually require a 10% deposit to be paid this can be negotiable with the vendor for the reduction of 5% or the use of a deposit bond. I can provide further assistant with this.  At this stage you are in a position to lock in and for me to exchange your contracts (legally bind you to purchase the property).

All post property searches and enquires are taken care of at this time along with liaising with all parties including the real estate, the vendors representative and your bank to make sure all requirements are meet and funds are available for settlement to take place on time.

A full settlement report with your settlement figures and copies of relevant documents will be provided leading up to the completion of your settlement.

A pre-settlement inspection is an important part of the settlement process. This allows you to take one last look at the property prior to settlement to make sure the property is in the same condition as when you negotiated the purchase and any requirement by the vendor prior to completion have been taken care of.

I will insure that your title is transferred to you correctly free of any dealings that may and would prevent settlement from taking place. All stamp duty requirements complete assisting with any government exemptions including the first home buyers scheme application.

Settlement in NSW occurs electronically all documents are lodged with NSW Land Registry Office and funds are transferred to the relevant parties.

Once settlement is completed keys can be released and you can move into your new home. Any title deeds will be sent to you or if there is a mortgage the bank will retain. Additionally a full report of your settlement details and relevant correspondence will be forwarded to you.

Transferring property between family members is a common occurrence. This could be a transfer between partners, a gift to a child, sale to a sibling, a relationship breakdown, divorce or death.

Once you have decided how the property is to be transferred, I will be able to advise you if the property transfer will be liable for payment of transfer duty, more commonly known as stamp duty.

Stamp duty is determined by the value of the property. The valuation will be carried out by a registered valuer, which I can help you arrange. If part of the ownership is transferred, stamp duty will be calculated based on the share of the property being transferred.

My service also includes fulfilling all requirements by the NSW Land Registry Office and Revenue NSW, including any exemptions and declarations to make this process seamless and stress fee.

If you require a discharge of mortgage or you are borrowing funds, I will liaise with your lender to make sure they will be in a position for settlement to take place.

On settlement I will attend to lodgement of the transfer and Notice of Sale electronically and pay settlement monies to the transferor (if applicable).
